Nurse Licensure Compact Legislation
Introduced in 1999

Arkansas: S.B. 28, the Compact legislation, was signed by the Governor on 2/23/99, and will go into effect in July 1999.

California: The California Department of Consumer Affairs ruled that "The Constitutionality of the Compact as drafted is not a clear issue ..."

Iowa: Interstate Compact draft legislation died in the House and Senate committees on 3/12/99.

Kansas: The Kansas Attorney General ruled "We believe the enactment of the nurse licensure compact as it is presently drafted would be an unconstitutional delegation of legislative authority..."

Maryland: S. 590 was signed by the Governor on 4/27/99. The Attorney General ruled that "this no more constitutes an invalid delegation of legislative power than do the provisions of law that permit a nonresident to drive here..."

Nebraska: L.B. 523 was designated as a "Speaker's Priority" bill on 3/16/99. The 1999 session adjourned 5/27/99; legislation carries over to the 2000 session. The Attorney General ruled the bill "an impermissible delegation of the legislative power."

North Carolina: S.B.194 was signed by the Governor on 7/2/99.

Texas: H.B.1342 was signed by the Governor on 6/19/99.

Utah: In 1998, Utah was the first state to enact National Council of State Boards of Nursing mutual recognition compact language. This year, the Governor on 3/17/99 signed S.B. 26, which amended prior legislation to coincide with bills introduced in other states.

Wisconsin: A.B.305 passed the Assembly on 6/1/99; hearings began 9/23/99 in the Senate Committee on Human Services. The attorney general ruled that "... I cannot predict with the certainty that the Kansas and Nebraska Attorneys General predicted for their states that the Wisconsin courts would determine such undiscriminating reciprocity to be an unconstitutional delegation of the legislative power..."
